Terms and Conditions of probation
  • Maintain good and lawful behavior. Commit no other criminal offenses.
  • Report to the Benton County Probation Dept., in person, no less than one time during each calendar month or as directed by the probation officer.
  • Permit the probation officer to visit you at reasonable times at your home or elsewhere.
  • Answer truthfully all inquiries by the Court or probation officer.
  • Report any change or employment to the Probation Office within 48 hours.
  • remain within the jurisdiction of the Court (State of Indiana) unless granted written permission to leave from the probation officer. If you leave with or without permission, and are arrested in any other stat you hereby waive extradition and will not resist being returned to Indiana.
  • Seek and/or maintain gainful employment or be enrolled in a course of study or vocational training. Support all dependents.
  • Refrain from possessing a firearm or other deadly weapons. All weapons are to be surrendered immediately.
  • You waive your Fourth Amendment rights to search and seizure, including but not limited to, person and/or property.
  • You shall not buy, possess, have control of, or consume any alcoholic beverages, illegal drugs, hemp products, or controlled substances. Do not be present during the use of unlawful drugs.
  • Submit to urinalysis, blood or Breathalyzer tests as directed by the probation officer and pay for said tests before the end of probation.
  • Complete all financial obligations (court costs, fine, fees, etc...) within the time frame ordered by the Court.
  • If a violation of probation occurs during the probation period, a Petition to Revoke Probation may be filed up to 1 year after termination of probation or 45 days after the State receives notice, whichever is earliest.
  • Satisfy other conditions reasonably related to probationer rehabilitation:
  • Perform uncompensated work that benefits the community, _____hours.
  • Undergo home detention under IC 35-38-2.5 ___________ days / months / year(s).
  • Undergo lab test for HIV virus, if convicted of a sex crime listed in IC 35-38-1-7.1 (e) or (f).
  • Sex Offender School Zone Residential Restriction under IC 35-38-2-2.2. Probationers may not reside within 1000 feet of school property unless granted written permission from the Court.
  • Undergo medical or psychiatric treatment, if required by the court.
  • Attend educational programs directly related to the rehabilitation of the probationer. _______________
