All cases are filed in the Clerk's office at the courthouse. All filings must be accompanied by self addressed envelopes for all mailings to be done in the case. If mailings are to be certified, please include the completed certified articles.

We at the County Clerk's Office cannot answer any legal type of questions. We can assist you with the completion of the paperwork, but any legal questions will have to be directed to an attorney. If you do not have an attorney, we will refer you to the Bar Association at 812-426-1712.

Case Filing: Dissolutions - Pro Se (In Ones Own Behalf)   
  • Pro Se dissolution papers can be obtained from your local library
  • Complete papers and sign in from of a Notary Public
  • File in Fountain County Clerk's office with $100.00 cash
  • Wait 60 days, call the Fountain County Judge's Office at 793-3301 to set up a court hearing date.
Pro-Se Guidelines

Any person proceeding pro-se (in one’s own behalf) needs to be aware of the following:
  1. All pleadings filed must be in conformance with the law. 
  2. All persons will be required to comply with the Indiana Trial Rules, the Indiana Rules of Evidence and the local rules of the Court. 
  3. In dissolution actions involving children, real estate or retirement plans, the Court will not allow parties to proceed without the advice of legal counsel. 
  4. All persons appearing will be proceeding at their own risk and will be assumed to know the rules of procedure. 
  5. The Court is prohibited from giving legal advice and cannot instruct litigants in the procedures of the court. 
  6. Litigants must provide the Clerk with appropriate addresses for service and must supply the Clerk with self-addressed stamped envelopes if copies of pleadings are requested. If service is to be by certified mail, litigants need to provide the Clerk with the appropriate certified mail envelopes.

Protective Orders

A protective Order is a civil order that can be obtained if a Judge finds probable cause to believe that:

  • A person or member of the person's household has been physically abused, or
  • A person or a person's property has been threatened to be physically abused.

If one or more of these events has happened, you may be eligible to have a protective order issued. The Protective Order is good for up to one year unless terminated by the Court after further hearings. To file a Protective Order come to the Clerk's Office or call 793-2192 for more information regarding Protective orders.
